How overtime works in Ontario

Under Employment Standards Act, 2000, s. 22, an employee in Ontario is entitled to overtime pay of 1.5× their regular hourly rate for every hour worked beyond the threshold.

Ontario applies a weekly threshold only. Any hours worked beyond 44 hours in a week are owed at 1.5× regular pay. There is no daily overtime trigger in this jurisdiction.

Special rules & edge cases

  • Overtime averaging agreements are permitted with written employee consent.
  • Some roles are exempt, including most managers, IT professionals, and certain regulated professionals.

Worked example

An employee in Ontario earning $25/hour works 47 hours in a week: weekly OT is 3 hours, paid at $37.50/hour.
